1. APPLICATION
These general conditions of use and sale detailed below (hereinafter referred to as the "General Conditions"), govern the contractual relationship between any user of the Website http://www.alaskanmaker.fr (hereinafter referred to as the "Website") wishing to make a purchase from Alaskan MAKER via the Website (hereinafter referred to as the "Customer") and the company Millenium, Limited Liability Company with a capital of 1,000 €. The company Millenium is registered with the trade and companies register of Roubaix-Tourcoing under the n° SIRET 82440103800016.
Alaskan MAKER has for main activity the sale of goods on the site. As such Alaskan MAKER is subject to the French laws in force, in particular the law "Informatique et Libertés" and the law "Pour la Confiance en l'Economie Numérique", in its capacity as a remote seller via the Internet.
The general terms and conditions of sale detailed below apply to all orders placed with the company MILLENIUM SARL, for all items and services offered on the site Alaskan maker.fr, unless otherwise agreed in writing. These general conditions of sale are systematically proposed to you at the time of ordering.
It is specified that you can save or print these general conditions of sale.
All commercial operations carried out by our Company are subject to these general conditions of sale which govern the contractual relationship between any user of the site www.alaskanmaker.fr wishing to make a purchase via the site alaskanmaker.fr and the company Millenium SARL, registered in the Trade and Companies Register of Roubaix-Tourcoing under the SIRET number 82440103800016, (hereinafter referred to as "Alaskan MAKER").
At any time, Alaskan MAKER can be brought to modify some of the provisions of these General Conditions of Sale. Consequently, it is necessary to take note of the version in force, the day of the order on the Site. These modifications are enforceable as of their posting on the Site and will be applied to orders placed after their posting on the Site.
The last date of update of the general conditions of sale is indicated at the bottom of this page, in the paragraph "Update".
Any purchase on the Website is subject to all the clauses of the General Conditions. The Customer will be able to validate his order only after having duly read the General Conditions and having accepted them by checking the box dedicated to this effect. By validating the General Conditions, the Customer declares that he/she has the legal capacity to conclude a contract in the sense of articles 1123 and following of the French Civil Code.
2. DEFINITIONS
For the understanding of the General Conditions, the following terms should be defined:
- Territory: Refers to France and Belgium.
- Users: Refers to any person located in the Territory connecting to the Site.
- Classic Sale: Refers to the permanent sale of a product in the catalog.
- Preview Sale, Flash Sale or Event Sale: Refers to the occasional sale of a product for a limited period of a few days, depending on the products and specified on their sales sheet.
3. PRODUCTS
The products offered for sale by alaskanmaker.fr on the Website (hereinafter the "Products") are described on the site. They will be the subject of an individual product sheet that will present at least the essential characteristics of the product from the information provided by partners, suppliers or manufacturers. The characteristics will have an indicative value. The products will also be the subject of a presentation by photographs, without contractual value. Alaskan MAKER can also propose "Promotions": the products which are the subject of it (on the price or any other characteristic such as for example the delivery, the quantity, etc.) will be sold during a limited time and/or quantity.
4. ORDERING METHODS
Orders are placed exclusively on the Internet according to the following steps:
- the Customer fills the cart with Products,
- the Customer creates an account or connects to his/her account if he/she is already a member of the website alaskanmaker.fr ,
- the Customer fills in the information concerning the delivery details,
- the Customer is informed about the method of delivery and the amount of shipping costs,
- the Customer chooses the method of payment,
- the Customer validates the General Conditions and the order,
- the Customer is redirected to a page of our partner paypal carries out the request for payment,
- finally, the Customer receives an e-mail validating the order.
The Customer is required to verify the completeness and truthfulness of the information he/she provides to alaskanmaker.com during the order and particularly his delivery address. The order validation e-mail means the acceptance by alaskanmaker.com of the Customer's order and thus forms the sales contract between the parties according to the provisions of the General Conditions. The information provided by the Customer and the General Terms and Conditions form the contract between the Customer and alaskanmaker.fr and will be recalled in the order confirmation e-mail. The Customer is responsible for the conservation of this validation email representing his copy of the sales contract. alaskanmaker.fr cannot be held responsible for the fact that this email is deleted by an "anti-SPAM" device. The Customer can access the content of their order at any time by logging on the Website and opening the tab "My Account / My Orders".
The General Conditions can be consulted from any page of the Website.
5. AVAILABILITY
Within the framework of the Classic Sales, the offers of Products are valid as long as they are visible on the Website. In case of unavailability of the Product after the order, the Customer will be informed by e-mail or by phone of the delivery of a partial order or of the cancellation of his/her order. In the context of a Flash Sale, Customers may order the Products put on sale only during its duration and under the specific conditions indicated on the Site.
6. PRICES
The sale prices of the Products offered on the Site in the Sales Sessions are indicated in Euros and increased with the VAT rate applicable on the day of the order.
Price to be paid: The price to be paid is the price indicated on the Website in the Product file, increased by the accessory costs (in particular the delivery costs and the service options) communicated at the time of the order. It may be reduced by a discount (for example, promotional codes or vouchers). The price will only be final upon confirmation of the order. All prices are displayed on our Site in Euros and include all taxes ("TTC").
Promotional codes or vouchers: the customer can benefit from personal and non-transferable promotional codes or vouchers that he/she can use during the validation of his/her order by entering their reference in the purchase form. It is specified that the promotional codes or purchase vouchers are valid only for the duration indicated by the company Alaskan MAKER to the customer.
Shipping costs: The shipping costs are due with each order placed. The exact amount of the carriage costs depends on the selected mode of delivery, the place of delivery of the order and its contents. The amount of the shipping costs will be indicated in the shopping cart and will be submitted to the approval of the Customer before the validation of the cart. To obtain an estimate, the Customer may proceed to a simulation of his purchases on the Website. In any case, this indication remains an estimate and only the price retained at the time of the validation of the basket has contractual value, except for exceptions such as delivery difficulties or special delivery methods that may generate additional costs.
Discount and VAT: Orders are payable immediately. There will be no discount practiced. In case of modification of the VAT rate, the price will be automatically modified without other notice than the legal date of requirement of the new rate.
Price variations: The prices of Products appearing on the Website are subject to change. Alaskan MAKER reserves the right to modify the prices without prior notice, in particular in the event of a labelling error. Subject to the following, the prices appearing at the time of purchase are the prices applicable to that purchase. Although care has been taken in the preparation of the website, it is possible that the prices indicated may contain errors. Alaskan MAKER is in no way bound by its offer and reserves the right to cancel the customer's purchase if such an error occurs.
Foreign currencies: The prices are indicated in Euro. If the currency of payment differs from the currency in which the prices appear, the Customer's bank will apply its exchange rate in force on the date of the purchase, beyond the control of Alaskan MAKER.
7. METHOD OF PAYMENT
Once the General Condition of Sales are accepted, the CUSTOMER proceeds to the payment of his/her order, which can be done
- by PayPal
- by credit card (for the entire territory) via a third party service provider ensuring the security of transactions. The CUSTOMER must have a debit or credit card as follows: Carte Bleue®, MasterCard®, VISA® or American Express®.
The Customer indicates his/her contact information, validates the basket and the total price. He/She validates his order by clicking on the "Payment" button and is then redirected to a page of our partner Paypal where he/she provides his/her credit card information. The receipt of a confirmation by alaskanmaker.fr validates the sale. The sale is then concluded under the suspensive condition of the availability of the product and thus of the reception of a confirmation sent by alaskanmaker.fr to the email address indicated by the Internet user during the purchase.
If the payment method selected by the customer is not successful, in particular due to a bank account balance that is too low or incorrect bank details, the customer is responsible for all costs incurred by the intervention of a third party to resolve the payment.
alaskanmaker.fr retains ownership of the goods sold until the delivery of the goods to the Customer or to the recipient designated by the Customer. Failure to pay either may result in the reclamation of the goods. These provisions do not prevent the transfer to the Internet user, upon delivery, of the risks of loss and deterioration of the goods purchased as well as the damage they could cause.
8. SECURITY OF PAYMENTS
alaskanmaker.fr has chosen powerful and rigorous tools in terms of security of payment methods. alaskanmaker.fr has adopted for the means of payment a Paypal solution using the SSL (Secure Socket Layer) encryption process, one of the most powerful security systems at the moment, and which establishes an encrypted connection directly between the Customer and the bank.
Paypal is also PCI DSS certified by Visa & Mastercard, which guarantees a high level of security for payment methods.
Alaskan MAKER has no access to confidential information relating to the payment method used by the Customer during the payment. This is why the Customer's bank details will be requested for each new order. Indeed, only Paypal has the confidential information which remains inaccessible to third parties.
Although Alaskan MAKER uses encrypted security software, the security of information and payments transmitted by Internet or via e-mail cannot be guaranteed. Alaskan MAKER shall not be liable for damages resulting from the use of electronic means of communication, including - but not limited to - damages resulting from failure or delay in the transmission of electronic communications, interception or manipulation of electronic communications by third parties or by computer programs used for electronic communications and for the transmission of computer viruses.
9. DELIVERY
9.1 Terms of delivery:
The Products are shipped within the Territory defined in these General Conditions.
Delivery will be made by a delivery company according to the choice of Alaskan MAKER (GLS, Colissimo or Mondial Relay for order within France), depending on the weight and dimensions of the package. The delivery of each product composing the basket could be carried out independently. The Customer must carefully fill in all the fields of the delivery form at the time of the order, including his/her delivery details and indicate a landline or mobile telephone number. Neither Alaskan MAKER, nor the transport company can be held responsible for an impossibility of delivery because of an imprecision or error in the delivery address.
9.2 Delivery times:
The delivery times indicated during the validation of the order are calculated in working days and are specific to each Product. Due to the variety of supply zones, manufacturing and logistical constraints, and the nature of "on demand" manufacturing of certain products, these lead times may vary and Alaskan MAKER shall not be held responsible. In any event, the delivery time for the Products shall not exceed twenty (20) weeks from receipt by the Customer of confirmation of his order.
9.3 Additional costs:
In the event of impossibility of delivery on the day of the Appointment due to inappropriate information, difficulties of access or passage not previously indicated by the Customer or absence of the Customer at the Appointment in violation of the commitments made at the time of the contact, new delivery charges may be invoiced by Alaskan MAKER, which will contact the Customer for payment of these new delivery charges before any new delivery of the Product. In the event of non-payment of these expenses, Alaskan MAKER reserves the right not to proceed with the delivery of the Product. The risks of damage resulting from these constraints will also be the responsibility of the Customer.
9.4 Postponement of the delivery date/Change of place of delivery:
If the Customer wishes to change the delivery address or postpone the delivery date, it shall notify Alaskan MAKER as soon as possible and no later than five (5) working days before the scheduled delivery date. To inform Alaskan MAKER, the Customer shall use the "Contact" section made available to him on the Site or in his "My Account" space. The Customer must quote his/her order number, the Product concerned and indicate his/her comments justifying the changes. Alaskan MAKER will then confirm its acceptance or its motivated refusal, by e-mail or telephone as soon as possible.
9.5 Receipt of ordered products:
At the time of delivery, the Customer must unpack the Product in the presence of the Deliverer/Courier and check that the Product delivered corresponds to his/her order and that no damage affects his/her Product before signing the delivery note. In case of anomaly, the Customer will have to write precisely the nature of his/her reserves on the delivery order. These reservations must be handwritten, dated, detailed and accompanied by a signature on the delivery slip. The mention "damaged product" is, for example, not explicit enough. The customer must indicate the nature of the damage: scratches, dents, stains, etc. Similarly, if a delivery error is noted, the Customer must specify the nature of the error: wrong color, damaged leather, wrong reference, etc.
In the event of error or damage, the Customer will have imperatively to refuse the Product and to forward to us his/her reserves under five (5) days by e-mail via the heading "Contact" of the Site and simultaneously by registered letter with acknowledgement of delivery to the address indicated by the customer service of Alaskan MAKER.
Any complaint addressed beyond these deadlines cannot be accepted. If the Customer does not express reservations, the delivered Product is considered satisfactory and cannot be the subject of any later dispute. For example, the Customer shall not be able to express any reservations either to Alaskan MAKER or to the Deliveryman/Courier, after the departure of the Deliveryman/Courier, even if the package has not been opened in the presence of the latter.
Except in cases of lack of conformity or hidden defects, no claim and/or subsequent reservation shall be accepted by Alaskan MAKER, after receipt of the Products by the Customer, if the latter has not complied with the procedure described above.
10. CANCELLATION
The Customer has the possibility of cancelling any order for products, without charge and without giving any reason, provided that it has not already been shipped.
To request cancellation of an order, the Customer shall contact Alaskan MAKER by e-mail via the "Contact" section of the Site or by telephone at the number indicated. If Alaskan MAKER can satisfy the customer's request, a confirmation e-mail will be sent and the Customer will be fully reimbursed. If the Products ordered by the Customer have left the warehouse of Alaskan Maker in France and have been taken over by a carrier, it is still possible to cancel the order but, in this case, the refund will be reduced by the delivery costs incurred. The Products will be delivered and the Customer must refuse them upon receipt. The Products will be returned to Alaskan MAKER and the amount of the order will be entirely refunded to the Customer except for the delivery costs.
11. WITHDRAWAL
11.1 Products not personalized
The Customer has fifteen (15) days as from the reception, to make with its expenses the return of its order whatever the reason.
If the deadline expires on a Saturday, Sunday or holiday, the deadline is extended to the next business day at midnight. In order to facilitate the handling of the Customer's request for withdrawal, it is possible to send such a request to Alaskan MAKER through the "Contact" section made available to the Customer on the Site or in the "My Account" space. The request for retraction thus addressed shall put an end to the fifteen (15) day period which runs from the date of receipt of the Products. The customer can also inform Alaskan MAKER by sending a letter to the address indicated by the customer service Alaskan MAKER, or by telephoning the Customer Service at 03 20 27 38 90 (Price of a local call, from Monday to Friday 10:00 am - 12:00 pm and 2:30 pm - 8:00 pm).
In the event of exercise of the right of withdrawal, Alaskan MAKER will refund the Customer of the totality of the sums paid as soon as possible and at the latest within thirty (30) days of the reception by the Seller of the returned product. The refund will be made by bank transfer or with the agreement of the Purchaser in the form of vouchers for a Product of a value of less than 500 euros. The basis for the refund is the total amount paid. But the expenses of return of the Product are with the whole load of the Purchaser.
The Seller can also propose a Product of an equivalent quality and price. The Products must be returned by mail or by a carrier in their original state and complete with their original packaging, with a copy of the invoice and sufficient postage. Products that are incomplete, damaged or spoiled by the Buyer or that have been subject to abnormal use are not accepted.
Alaskan MAKER will carry out a quality control of the Product at the warehouse. The Products must imperatively be in new condition, given in their original packing, without any trace of use, be accompanied by their accessories and possible instructions for use or assembly. It is only after having checked that these conditions are satisfied that Alaskan MAKER will proceed to the refunding of the sums perceived under the returned products. If the conditions mentioned are not met, the refund of the Customer will be decreased by the amount corresponding to the loss of value of the Product, noted at the time of the control.
In order to ensure the return and reception of the Product in the best conditions and to guard against any risk of loss or damage, it is recommended to the Buyer to contact the Seller at the customer service at 03 66 73 25 29 (Price of a local call, from Monday to Friday 10:00 am - 12:00 pm and 2:30 pm - 8:00 pm), and this, before returning the Product. A return number will be assigned to the Product and communicated to the Buyer as well as all useful information on the procedure to follow for optimum management of returns.
In the event of abnormal or abusive returns Alaskan MAKER reserves the right to refuse a subsequent order.
Throughout the procedure, the Customer will be informed by e-mail of the reception of his will to retract, the return of his parcel as well as the date of refunding.
11.2 Personalized products
We draw the attention of the Internet user to the fact that the right of withdrawal described above does not apply to objects that have been personalized. As stated in the Consumer Code Article L121-20-2: "The right of withdrawal can not be exercised, unless the parties have agreed otherwise, for contracts for the supply of goods made to the specifications of the consumer or clearly personalized or which, because of their nature, can not be reshipped ... ".
The customer is therefore 100% responsible for the creation that he/she validates at the time of the order.
Nevertheless,
- If the Customer wishes to remake his/her customizable product because of an error for which Alaskan MAKER is not responsible (spelling mistake, wrong size ordered, etc.), Alaskan MAKER grants an exceptional reduction of 50% for the recommendation of the same product, with the same design and correction of the error made by the customer.
- If the Customer wishes to return its customizable product, it will have to return the product at its expenses and Alaskan MAKER will exceptionally refund the customer of an amount equivalent to 50% of the total amount paid (as soon as possible and at the latest within thirty (30) days of the receipt by the Seller of the returned product). The refund will be made directly by transfer to the account of the card used for the transaction, or by Paypal, or by check, or with the agreement of the Customer in the form of vouchers. The basis for the refund is the total amount paid (product + shipping costs), but the cost of returning the product is the responsibility of the Customer.
12. WARRANTY
The Customer may notify Alaskan MAKER of the non-conformity of the Product with the object of his/her order after receipt of the Product. To do this, the Customer may use the "Contact" section of the Website. It will describe there the nonconformity of the delivered Products and his/her choice between exchange and refunding. If the Product initially ordered is no longer available, the Customer may request an equivalent Product or a refund. Alaskan MAKER will describe to him the procedure to be followed to carry out free the return of the Products before reception of the new product or refunding. Nevertheless, Alaskan MAKER reserves the right to refuse any exchange, if this one would engage disproportionate costs, and to opt for the refunding.
This procedure cannot be used within the framework of the exercise of the right of retractation, in which case the expenses of return of the Product are entirely the responsibility of the Customer.
REPAIR
The Products are guaranteed by Alaskan MAKER for one (1) year from receipt of the Product by the Customer if he/she notices a defect in conformity on the Products. It will have to contact Alaskan MAKER by e-mail via the heading "Contact" of the Website. It shall also send to Alaskan MAKER its request by registered mail with acknowledgement of receipt to the address mentioned in the article "Withdrawal".
Before giving its agreement on the assumption of responsibility for the Product in guarantee, Alaskan MAKER will check that:
- The Product conforms to the Product that was sent to the Customer, without damage or particular modification.
- The defect reported by the Customer is not the consequence of:
- abnormal use of the Product;
- normal wear and tear or aging of the Product;
- an accidental event possibly caused by the Customer or a third party.
In addition, the shipping and return costs of the Products remain entirely at the expense of the Customer.
If the above conditions are met, Alaskan MAKER undertakes to repair the Product. If a repair is not possible, Alaskan MAKER will propose to the Customer to replace its Product by an equivalent product or to refund it with a purchase voucher corresponding to the value of its first purchase.
CONCEALED DEFECTS
Alaskan MAKER guarantees the Customer against all the consequences of the hidden defects which would be likely to affect the Products sold, except contrary opinion stipulated on the Website in accordance with the provisions of French law.
The guarantee for latent defects applies only if the Internet user proves that the defect which it noted already existed before Alaskan MAKER delivered its product to him. It is the responsibility of the Internet user to have the product appraised at his expense to obtain proof of the existence of the hidden defect.
The responsibility for Alaskan MAKER could never be higher than the value of the article in question. Moreover, no other compensation could be claimed by the Net surfer apart from those which are expressly envisaged by the Code of the Consumption.
13. INTELLECTUAL PROPERTY
Alaskan MAKER is a protected trademark registered with the INPI.
The site www.alaskanmaker.fr is the exclusive property of Alaskan MAKER and cannot be used without our prior agreement.
The graphic and editorial elements presented on the Site are the property of Alaskan MAKER and are protected by copyright. The presentation of products (photographs, videos, drawings, product sheets, etc.), whether they are for sale or not, are also the property of Alaskan MAKER or its partners and may not be reproduced without the express authorization of their respective owners. Any copy or reproduction, any use of all or part of our graphic and/or editorial elements or of any presentation of our products is strictly prohibited and constitutes an infringement of our intellectual property rights which will be prosecuted and punished as such. However, hypertext links to the site are authorized without specific request.
14. COOKIES
In order to better serve Users and Buyers, the Seller measures the number of pages viewed, the number of visits, as well as the activity on the Website, and the frequency of returns.
To this end, the Seller uses "cookie" technology. These cookies store information relating to the browsing of Users and Buyers on the Site (the pages consulted, the date and time of the consultation, etc.).
The Seller can read this information during the next visits. These cookies do not allow the Seller to identify the Users and the Buyers. The Customer can oppose the recording of the cookies by parameterizing his/her browser in the following way:

15. PRIVACY
The Website Alaskanmaker.fr has been declared to the CNIL on April 19, 2017 under the registration number:2056997.
Pursuant to Law No. 78-17 of January 6, 1978, it is recalled that the personal data that are requested from the Customer are necessary to process his/her order.
Alaskan MAKER undertakes to use the confidential information of its Internet users only within the framework of the operation of its Site.
At the first request of the Internet user wishing to no longer appear in the Alaskan MAKER database, we undertake to deactivate all contact details and information relating to the member concerned.
Alaskan MAKER may apply technical means to obtain non-personal information relating to Internet users and intended to improve the functionality of the site, for example by tracing the number of visitors to the site.
Furthermore, Alaskan MAKER only collects personal data such as name, first name, address and e-mail address if these are given voluntarily by the visitor. The data collected in this way may not be used for any commercial purposes other than those referred to on the Website or which may be developed subsequently by Alaskan MAKER.
None of the information may be transferred to third parties without the express agreement of the member at the time of registration or subsequently in his or her data management area. Each member has the right to access, modify, rectify or delete data concerning him/her (Article 34 of the Data Protection Act). To exercise this right, they should contact Alaskan MAKER by sending an e-mail to celine@alaskanmaker.fr or, at any time, by modifying their data in "My account".
16. SPONSORSHIP
Alaskan MAKER allows its Customers/Members to sponsor their relatives and friends in order to make Alaskan MAKER known. The sponsored persons must validate their sponsorship by indicating the e-mail address of their sponsors.
17. DISPUTES AND RESPONSIBILITIES
The Customer is required to verify the completeness and truthfulness of the information provided to Alaskan MAKER at the time of the order and in particular the delivery address. Alaskan MAKER cannot be held responsible for possible data entry errors which could cause delivery errors. Alaskan MAKER cannot be held responsible for the failure of the Customer to comply with the terms of delivery and the Appointment which he will have fixed with the carrier. If necessary, the expenses necessary for the forwarding and the storage of the products will be the responsibility of the Customer. Without limiting the preceding paragraphs, the responsibility of Alaskan MAKER cannot exceed a sum equal to the amounts paid or payable at the time of the transaction at the origin of the aforementioned responsibility, whatever the cause or the form of the action concerned. Are considered as fortuitous event or force majeure exonerating responsibility all facts or circumstances irresistible, unforeseeable and independent of the will of the parties in particular in the event of total or partial strike of transporters, riots, war and natural disasters.
The choice and purchase of goods by the Customer are under his sole and unique responsibility. Consequently, the total or partial impossibility of using the Products in particular because of incompatibility of the material cannot give place to any compensation, refunding or questioning of the responsibility for Alaskan MAKER, except in the case of a proven hidden defect, nonconformity, defect or exercise of the right of retractation envisaged by the French Code of the Consumption.
18. SETTLEMENT OF DISPUTES
The General Conditions shall be executed and interpreted in accordance with French law. The parties shall seek, before any litigation, an amicable agreement, it being recalled that the latter does not interrupt the time limits for taking action in warranty. Any dispute of any nature or any dispute relating to the formation or the execution of the order, even in the event of recourse in guarantee or of plurality of defendants, will be in the absence of amicable agreement of the exclusive competence of the courts in the jurisdiction of which the registered office of Alaskan MAKER is located. The competence of the courts will be done in accordance with the rules of the Code of Civil procedure when the purchaser does not have the capacity of professional.
19. LANGUAGE
The General Conditions, orders, correspondence e-mails as well as the sales contract concluded with the Customer are in French language for the Territory.
20. SEVERABILITY OF CLAUSES
